Waiver and Release of Liability

In consideration of Signatory (hereinafter referred to as "Guest") being allowed to participate in activities at METfit, Inc. (hereinafter referred to as "METfit") the sufficiency of said consideration hereby acknowledged, both Guest and METfit agree as follows, Guest's use of METfit facilities, services, products, equipment, or premises, involves risks of injury to persons and property, and Guest assumes full responsibility for such risks. Such risk of injury include, but are not limited to, heart attacks, strokes, heat stress, sprains, strains, broken bones, torn muscles, tendons, ligaments, and up to and including permanent disability or death. Upon entering METfit for any purpose including, but not limited to, observation, use of facilities, services, products, equipment, or participation in any way, Guest agrees to the following:

1. Guest understands that the use of facilities, services, equipment or products is the sole choice and entire responsibility of Guest.

2. Guest understands and agrees to abide by METfit rules and regulations for the usage of facilities.

3. Guest has conducted a complete, independent inspection of the METfit facility and has found it satisfactory for Guest needs and purposes.

4. To the fullest extent permitted by law, Guest hereby releases and holds METfit, its owners, directors, officers, employees and agents, harmless/blameless from all liability to Guest, and Guest's personal representatives, for loss or damage and waives any claim or demands therefore, on account of injury to Guest's person or property, including injury leading to the death of Guest while Guest is in, upon, or about METfit's premises, including any injuries arising out of the negligence of METfit or its owners, directors, officers, employees and agents.

5. Guest represents that they are in good physical condition and has no disability, illness, or other condition that could prevent Guest from exercising without injury or impairment of health, and that Guest has consulted a physician concerning an exercise program that will not risk injury to Guest or impairment of Guest's health.

6. Each clause of this release agreement is a distinct and severable clause and if any clause is deemed illegal, void, or unenforceable, the validity, legality, or enforceability of any other clause of this Agreement will not be affected thereby.

7. This release agreement shall be governed by and construed and interpreted in accordance with the laws of the Commonwealth of Massachusetts. Each party to this agreement agrees to submit to the exclusive jurisdiction of the courts in Middlesex County, Massachusetts.

I, %%SIGNER_NAME%% hereby agree to indemnify METfit from any loss, liability, damage or cost METfit may incur due to the presence of Guest in, upon, or about the METfit premises; whether caused by the active or passive negligence of Guest, or METfit facilities, equipment, services, products or representatives. I (Guest and/or Parent/Guardian) have read this release and waiver of liability and indemnity clause, and agree to its conditions and content.
